Terms of Service

 

Personal computers will be evaluated for repair and cost estimates will be provided to the requestor. All computers are believed to be in working order unless otherwise noted. We are not accountable for defective electronic components that fail during testing; it is the sole responsibility of our customer to back up their data "before" it is brought in to LUBBOCK COMPUTERS to be worked on. Accidents do happen and we will not be held accountable for any component or lost data, this includes laptop components. Not all systems are able to be repaired/service over the internet. WE ARE NOT RESPONSIBLE FOR DATA LOSS DURING REPAIR EVEN IF WE TRY TO BACK IT UP

  • We can not always tell if your system is running slow. Remote connection speed, computer memory, age of system,
    other mechanical issue's.

  • Not all repairs can be done online. Read END USER LICENSE AGREEMENT

  • For the free estimate Our software only works when YOU initiate the connection.  Once the software is closed, we can't get back into your computer until you re-open it.

  • Sometimes during Malware (virus/spyware) removal the operating system will get corrupt and may need to be reinstalled.
    You will need to bring in your computer.

  • WE ARE NOT RESPONSIBLE FOR DATA LOSS DURING REPAIR.

Fact: 98% of all personal computer problems are software related, this means that in almost all cases we don’t need to physically “touch” your machine. There is a 2% you will have to bring it in.

·    Examine your computer to locate and remove any file sharing programs Peer 2 Peer programs (Limewire, Ares, Bearshare, ect.) are the number one cause of Malware Infections.

·    Computers must have Microsoft XP, Vista or Windows 7 installed and a working broadband internet service connection – Sorry no dail-up.

 

 

We will... 

  • Every 90 days we log into your computer and perform the following service.
  • Adjust your system settings for the fastest and smoothest performance possible
  • Clean up your hard drive and free more space.
  • Apply the most recent security updates and patches for your operating system.
  • Update your system with the current operating system security updates
  • Remove unneeded startup items and unneeded programs
  • Determine if your firewall is enabled
  • Check your antivirus software to be sure it is working properly
  • Scan for viruses, spyware, malware and rootkits
  • Review your computer's history of visited web sites and offer suggestions on which ones to avoid in the future
  • Offer advice and suggestions on how to best keep you and your family safe online
  • Offer online storage for backing up your vital data.
  • Most users will have us install a listener on their system and allow us to remote log in during
    the day while they are at work.
  • This is a preventive maintenance not a guarantee, everything is mechanical and subject to fail.
  • Any Security software is extra. (no free or limited programs)
  • 1 free service call per quarter

END USER LICENSE AGREEMENT
Software License Agreement for Remote Login Connection

IMPORTANT- PLEASE READ CAREFULLY: BY INSTALLING THE SOFTWARE (AS DEFINED BELOW), COPYING THE SOFTWARE AND/OR CLICKING ON THE 'ACCEPT' BUTTON BELOW, YOU (EITHER ON BEHALF OF YOURSELF AS AN INDIVIDUAL OR ON BEHALF OF AN ENTITY AS ITS AUTHORIZED REPRESENTATIVE) AGREE TO ALL OF THE TERMS OF THIS END USER LICENSE AGREEMENT ('AGREEMENT') REGARDING YOUR USE OF THE SOFTWARE. IF YOU DO NOT AGREE WITH ALL OF THE TERMS OF THIS AGREEMENT, CLICK ON THE 'NO' BUTTON. THIS WILL CANCEL THE INSTALLATION.

1. GRANT OF LICENSE: Subject to the terms below, Lubbock Computers hereby grants you a non-exclusive, non-transferable license to install and to use Remote Login Connection ('Software').
Under this license, you may: (i) install and use the Software on a single computer for your personal, internal use (ii) copy the Software for back-up or archival purposes. (iii) You may not distribute the software to others without first obtaining the required licenses, where applicable.
Whether you are licensing the Software as an individual or on behalf of an entity, you may not: (i) reverse engineer, decompile, or disassemble the Software or attempt to discover the source code; (ii) modify, or create derivative works based upon, the Software in whole or in part without the express written consent of Lubbock Computers; (iii) distribute copies of the Software; (iv) remove any proprietary notices or labels on the Software; (v) resell, lease, rent, transfer, sublicense, or otherwise transfer rights to the Software.

2. Remote Login Connection: You acknowledge that no title to the intellectual property in the Software is transferred to you. Title, ownership, rights, and intellectual property rights in and to the Software shall remain that of Lubbock Computers . The Software is protected by copyright and patent laws of the United States and international treaties.

3. DISCLAIMER OF WARRANTY:
YOU AGREE THAT Lubbock Computers HAS MADE NO EXPRESS WARRANTIES, ORAL OR WRITTEN, TO YOU REGARDING THE PRODUCTS AND THAT THE PRODUCTS ARE BEING PROVIDED TO YOU 'AS IS' WITHOUT WARRANTY OF ANY KIND. Lubbock Computers DISCLAIMS ANY AND ALL OTHER WARRANTIES, WHETHER EXPRESSED, IMPLIED, OR STATUTORY. YOUR RIGHTS MAY VARY DEPENDING ON THE STATE IN WHICH YOU LIVE.
Lubbock Computers SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, COVER, RELIANCE, OR CONSEQUENTIAL DAMAGES RESULTING FROM THE USE OF THIS PRODUCT. YOUR COMPUTER CAN FAIL TO BOOT OR WORK PROPERLY AND YOU WILL NEED TO BRING IT INTO THE STORE FOR FURTHER SOFTWARE REPAIR.
HARDWARE IS NOT COVERED. THERE IS NO RE-INFECTION GUARANTEE AS WE DO NOT CONTROL THE AFTER OPERATIONS OF THE COMPUTER OR HAVE ANY CONTROL OF THE ANTI-MALWARE SOFTWARE.

4. LIMITATION OF LIABILITY: You use this program solely at your own risk.
IN NO EVENT SHALL Lubbock Computers BE LIABLE TO YOU FOR ANY DAMAGES, INCLUDING BUT NOT LIMITED TO ANY LOSS, OR OTHER INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND ARISING OUT OF THE USE OF THE SOFTWARE, EVEN IF Lubbock Computers HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL Lubbock Computers BE LIABLE FOR ANY CLAIM, WHETHER IN CONTRACT, TORT, OR ANY OTHER THEORY OF LIABILITY, EXCEED THE COST OF THE SOFTWARE. THIS LIMITATION SHALL APPLY TO CLAIMS OF PERSONAL INJURY TO THE EXTENT PERMITTED BY LAW.

5. TERMINATION: This Agreement shall terminate automatically if you fail to comply with the limitations described in this Agreement. No notice shall be required to effectuate such termination. Upon termination, you must remove and destroy all copies of the Software.

6. MISCELLANEOUS:

Severability.
In the event of invalidity of any provision of this Agreement, the parties agree that such invalidity shall not affect the validity of the remaining portions of this Agreement.
Export.
You agree that you will not export or re-export the Software outside of the jurisdiction in which you obtained it without the appropriate United States or foreign government licenses.
Governing Law.
This Agreement will be governed by the laws of the State of Finland as they are applied to agreements between Finland residents entered into and to be performed entirely within Finland. The United Nations Convention on Contracts for the International Sale of Goods is specifically disclaimed.
Entire Agreement.
You agree that this is the entire agreement between you and Lubbock Computers, which supersedes any prior agreement, whether written or oral, and all other communications between Lubbock Computers and you relating to the subject matter of this Agreement.
Reservation of rights.

All rights not expressly granted in this Agreement are reserved by Lubbock Computers.
